Vikram Sachdeva QC and Catherine Dobson act on behalf of successful Claimant in challenge to a decision to temporarily close an Accident and Emergency department

In a judgment handed down on 16th April, Mr Justice Linden held that the decision of Lincolnshire Hospitals NHS Trust to temporarily close Grantham and District Hospital A&E was in breach of the Trust’s duty under section 242(1B) of the National Health Service Act 2006 (the duty to involve service users) and unlawful. The decision is the first case to consider the interpretation of section 242(1B) of the National Health Service Act 2006.
