Contractual parties sometimes find themselves in situations where a counterparty attempts to manipulate the other into a repudiatory breach scenario, often as a means to get out of an unfavourable contract.
In this seminar, 39 Essex Chambers’ barristers Paul Hayes KC, Swee Im Tan and Ben Olbourne, alongside Lee Carroll of Johnson Winter Slattery will examine from the English law and Australian law perspective (a) contractual and common law termination, (b) the treatment of repudiatory breach of arbitration agreements and (c) anti-suit injunctions.
