The Supreme Court handed down judgment in Competition & Markets Authority v Flynn Pharma & Pfizer

The Supreme Court has, within the last few days, handed down judgment in Competition & Markets Authority v Flynn Pharma & Pfizer [2022] UKSC 14.  Andrew Tabachnik QC and Ruth Keating represented the SRA, which intervened into the appeals, securing express confirmation from the Supreme Court at paragraph 122 as to the continuing justification and applicability of the approach in Baxendale-Walker to the award of costs in the SDT.
