Steve Broach KC instructed in first judicial review challenge to SEND consultation

39 Essex Chambers’ barrister Steve Broach KC has been instructed in the first judicial review challenge to the SEND consultation

A family is challenging the government’s recently announced consultation on the SEND reforms, on the basis that the consultation document is unfair and irrational. Steve Broach KC represents Jessica Hayhurst, acting through her mother Melissa.

The claim alleges that the consultation process is unfair and irrational in failing to provide sufficient information on, and ask consultees about, some of the central legal changes that the government is proposing. These include removing the power of the Tribunal to direct placements and shifting the duty to secure provision from local authorities to schools.

Steve Broach KC is instructed by Rook Irwin Sweeney, acting pro bono at this stage. A response has been requested from the Secretary of State by 13 March 2026.
