Posthumous use of embryo with a surrogate

6th May 2022

The High Court has heard an application from Ted Jennings, a widower, for a declaration that it is lawful to use an embryo, jointly created with his and his late wife’s gametes, in treatment with a surrogate. The case raises novel issues about the application of the Human Embryology and Fertilisation Act 1990.

Jenni Richards QC, Catherine Dobson and Stephanie David act for Mr Jennings, instructed by James Lawford Davies of Hill Dickinson.
