Alexander Burrell successful in appeal before the DIFC Court of Appeal

Alexander Burrell, working with Horizons & Co Law Firm, has been successful in an appeal before the DIFC Court of Appeal, in the case RaDa Trading LLC FZC v (1) Wealth Bridge Trading Crude Oil and Refined Products Abroad LLC (2) Cohenrich Energy FZE CA-007-2021.

Acting as sole counsel throughout, following a successful strike out of RaDa Trading LLC FZC’s entire claim for $8,123,281.15 (which concerned alleged misrepresentation and breach of contract), Alexander successfully overturned the DIFC Court of First Instance’s decision to strike out Cohenrich Energy FZE’s counterclaim of $938,630.00 (concerning alleged breach of contract).

The appeal concerned whether the counterclaim had reasonable grounds, given that a clause within the assignment agreement provided that any variation was required to be in writing and signed.
