Disabled child’s human rights breached by issuing of care proceedings

39 Essex Chambers barristers Victoria Butler-Cole KC and Steve Broach KC acted for a disabled child, Ella Chapple, whose mother Elly Chapple has agreed a settlement with Northumberland County Council (‘the Council’) which includes recognition that Ella’s human rights were breached by the decision to issue care proceedings and the resultant disruption of her family life.

The order resulting from the settlement agreement also records that changes made to Ella’s bespoke care and education package while care proceedings were ongoing had a negative impact on her and caused her significant distress. The Council has agreed to pay £50,000 in damages as ‘just satisfaction’ for the breach of Elly’s human rights.
