Areas Of Expertise
Rebecca has a practice which spans several core areas of business and property law. These include banking, commercial litigation, insolvency (personal and corporate), fraud and property.
Rebecca appears regularly in the County Court and High Court. She was recently successful as sole counsel in a multi-track trial defending her client against various allegations surrounding a boundary dispute and building works. Rebecca has a particular interest in commercial disputes and has experience of cross examination where there are allegations of fraud. She is instructed in all types of hearings, including interlocutory and procedural applications.
In her advisory work, Rebecca focuses on astute tactical decision making. She is aware of the commercial realities which drive litigation and has a strong focus upon beneficial settlements.
Rebecca has an extensive clinical negligence practice. She acts for Claimants, families at inquests, insurers and medical indemnifiers. Rebecca is typically involved in conferences and strategy from the pre-litigation phase up to trial. She is accustomed to regularly questioning experts both in conference and in Court. Rebecca is often involved in cases requiring larger teams of experts to comment upon both liability and quantum.
Rebecca’s particular focuses in clinical negligence include: brain injury, cancer, gynaecology and obstetrics, ophthalmology, inquests, surgical cases and spinal cord injury. She also has experience of errors occurring at Accident and Emergency and by general practitioners. Rebecca has advised in multiple cases where there has been significant, recent legal evolution such as wrongful birth, failures of consent and surrogacy. She has a keen eye for causation issues.
Rebecca has experience of all matters relating to quantum including consideration of periodical payments and provisional damages.
In her advisory work, Rebecca consistently adopts a client-centered approach. She enjoys working closely with her solicitor client on difficult cases to achieve advantageous outcomes.
Rebecca has wide experience of the Coroners’ Courts, both as a typical advocate and as counsel to the inquest. She is currently retained as junior counsel to the inquest in His Majesty’s Coroner’s investigation into Ian Paterson alongside her usual practice. In this role, Rebecca leads a team of 7 other junior counsel. The inquests will examine both individual medical causation as well as broader Article 2 issues.
Rebecca is often instructed on inquests of all kinds including those involving accidents and clinical negligence in both hospital and community settings. Rebecca has also acted in Article 2 inquests involving police powers relating to the Mental Health Act and in cases of unlawful killing. She has appeared in jury inquests and is skilled in ensuring that complex factual matrices are understandable for a range of audiences.
Rebecca is accustomed to leading conferences prior to inquests and advising upon the gathering of relevant evidence. She guides clients through the inquest process, ensuring that good understanding is achieved throughout and expectations are managed appropriately.
Rebecca’s personal injury practice covers various elements of personal injury law. In particular, she is often instructed in cases with difficult factual circumstances and multiple conflicting witness accounts. Rebecca is experienced in advising upon workplace accidents and pedestrian vs car accidents which result in catastrophic and life changing injuries.
Rebecca has focused upon cases where there are allegations of fraud, including dealing with allegations of fundamental dishonesty at an appellate level. She also has advised extensively on contributory negligence issues.
