Peter Village KC is a barrister known for his sound judgment and resilience – qualities that have defined a distinguished career spanning over four decades – more than half of that time as a silk. Peter has earned a national reputation as a highly experienced and well-regarded King’s Counsel, focussing on planning, compulsory purchase, and related real estate matters.

In his distinguished career, Peter has acted in some of the most high-profile and contentious cases in the field. He is regularly instructed for his sound judgment, strong advocacy and cross-examination skills, as well as his pragmatism. Clients turn to him for second opinions or peer reviews when confidence in previous advice has faltered—an endorsement of his reputation for leaving no stone unturned.

Peter’s practice spans the full range of planning and related disciplines, including appearances at public inquiries, hearings, and across all levels of the court system—from the High Court to the Court of Appeal and Supreme Court. He is equally at home in planning-related commercial disputes (for example overage disputes, and breach of best endeavours clauses) as well as challenges to the grant of planning permission.

What distinguishes Peter is his dual perspective: he brings to his practice not only extensive legal expertise but also first-hand commercial experience in the property development sector. For six years, he also served as legal counsel to a major London-based property company, providing strategic advice on acquisitions and development. In addition, he has independently developed a significant mixed-use residential and retail-led scheme in Wandsworth, managing every detail from acquisition and planning through to final sale.

This hands-on experience led to his family company acquiring an unallocated site in Suffolk, securing permission for 2,000 homes—now under development. Peter led the entirety of this highly complex and multi-faceted process, including the resolution of overlapping land ownerships, relocation of overhead pylons, ransom strip negotiations, negotiations with Homes England relating to off-site highways infrastructure, and mitigating overage provisions.

His practical, real-world understanding of development dynamics offers clients something rare: strategic legal counsel from someone who knows precisely what’s at stake from the developer’s perspective.

Peter has long been the trusted adviser to some of the UK’s largest housebuilders, including acting for Taylor Wimpey for over 20 years. He represented CALA Homes in landmark litigation following the Secretary of State’s unlawful attempt to abolish Regional Strategies—successfully securing permission for a 2,000-home scheme now under way in Winchester.

Other major instructions include acting for University College London Hospitals NHS Foundation Trust in the compulsory acquisition and redevelopment of the Middlesex Hospital and the development of UCL Hospital; successfully representing Guinness in a highly complex and hard-fought ransom value dispute against Railtrack at Park Royal; and promoting Birmingham City Council’s CPO for the transformation and redevelopment of the Bull Ring..

Peter has also successfully resisted numerous CPOs on behalf of landowners—including Orchard Wharf and Blackwall Reach—and has advised on key infrastructure developments, including airports such as Robin Hood, Coventry, and London Ashford. He also successfully defended TAG Aviation in a major Land Compensation Act class action claim by hundreds of local residents in the vicinity of Farnborough Airport.

Internationally, Peter has been called to the Bar of the Bahamas, where he recently concluded (2024) a series of successful cases before the Appeal Board and ultimately the Supreme Court of the Bahamas on behalf of developers seeking planning permission for luxury condominium developments in the ultra-exclusive Lyford Cay estate.

He maintains a substantial advisory practice, frequently consulted on complex Section 73 and Hillside matters, CIL, as well as overage, best endeavours obligations, and development risk.

Heritage and conservation matters have always been key component of his portfolio. He has represented clients or advised in cases involving nationally significant listed assets such as the Rose Theatre, St Osyth’s Priory, and Althorp (on behalf of Earl Spencer). He successfully acted for Berkeley Homes in the Potters Field development at Tower Bridge, designed by the world-class architect Ian Ritchie—a site encircled by Grade I and II* listed buildings and directly facing a World Heritage Site.

Since 1985, Peter has served as counsel to Samuel Smith Old Brewery (Tadcaster), appearing in dozens of public inquiries, judicial reviews, and cases at all court levels, including the Supreme Court.

He successfully acted for the Environment Agency in the seminal case of Rowland v Environment Agency, which confirmed public navigation rights over a contested stretch of the Thames and defeating a claimed estoppel —prevailing in both the High Court and the Court of Appeal.

Never daunted by the difficult or the controversial, and what is thought to be unprecedented in the field of planning, Peter recently secured the recusal of a planning inspector mid-way through a planning inquiry on the grounds of her demonstrable bias—an extraordinary step that ultimately led to a successful appeal for a significant Green Belt development (April 2025) before a newly appointed Inspector.

He is relentless on behalf of his clients, a prime example being R. (on the application of Milton (Peterborough) Estates Company) v Ryedale District Council where each of the four grounds of challenge identified by Peter were rejected by the High Court at permission stage as being “total without merit” but, following appeal to the Court of Appeal, each ground was upheld leading to the successful quashing of a controversial retail store permission.

Consistently ranked in the top tiers of legal directories, Peter was named by Chambers and Partners as Planning Silk of the Year in 2012.

Peter continues to seek out new and challenging instructions, bringing a rare combination of legal mastery and commercial insight to every matter. Peter understands the importance of Alternative Dispute Resolution and has been involved in many mediations.

He is a qualified mediator and was recently instructed as mediator in the USA in a tripartite dispute involving land said to be worth hundreds of millions of dollars.

His unique experience as both barrister and developer gives him an unparalleled vantage point in understanding and unlocking the complexities of planning and development disputes—making him not only a formidable advocate but a true strategic asset to his clients. Peter remains deeply committed to expanding the boundaries of his practice. He actively seeks out new and intellectually demanding challenges, and seeks to bring a measured but imaginative approach to every case he takes.

Peter is a Governing Bencher of the Honourable Society of the Inner Temple. He is a member of the Planning and Environment Bar Association and the Compulsory Purchase Association.
