Mrs Justice Lieven held that an application brought by the local authority under the inherent jurisdiction of the High Court – to ensure that husband and wife lived separately – was a “colossal interference” with their Article 8 rights and was neither necessary nor proportionate. Alexis acted for the wife of the patient.
