This session will discuss key questions about the pleading, proof and recovery of global claims for time and money in construction disputes from the perspective of both the tribunal and the parties’ representatives.

The seminar will consider:

  • What exactly is a global claim?
  • How global claims are dealt with in different jurisdictions.
  • An Arbitrator’s and Counsel’s view on the approach to “Rolled-Up Claims”.
  • The causation issues.
  • The quantification issues.
  • Global claims for time and money – are they treated in the same way?
  • Is Walter Lilly and Co Ltd v. Mackay [2012] EWHC 1773 (TCC) right on time?
