David Mitchell’s article “Section 19A Equality Act – Confusion Codified” has been published in the Employment Lawyers Association (ELA) Briefing for January / February 2024. The article discusses whether s.19A, entitled “Indirect discrimination: same disadvantage”, codifies the CJEU’s judgment in CHEZ Razpredelenie Bulgaria AD v Komisia za zashtita ot diskriminatsia (C-83/14) into domestic law, as it purports to, and considers possible difficulties in the application and construction of this new species of discrimination law.
