International trade and investment law is a longstanding speciality of a number of QC’s and juniors at 39 Essex Chambers. They have expertise in relation to WTO Agreements, EU commercial, trade and customs law, bilateral investment treaties and relevant domestic law.
GATT 94 and other agreements relating to trade in goods such as TRIMs, anti-dumping, rules of origin, subsidies and countervailing measures are areas of special interest along with GATs and the dispute settlement process. The impact on domestic tax law of WTO law is an area of particularly topical concern.
Disputes relating to commercial and development policy, including its policy in relation to foreign direct investment, together with law on sanctions is an important part of the work within chambers.
Members of chambers are instructed by government authorities and investors from around the world as well as by multinational enterprises and smaller traders. They are instructed by professionals from around the EU and elsewhere as well as by UK-based clients.
The application and operation of the Union Customs Code in Member States is an area on which advice and representation is regularly given. Members represent traders not only in the UK, but also in a number of other countries and in disputes with customs authorities around the EU. All kinds of disputes are dealt with including, post-clearance recovery demands for customs duty and anti-dumping duty, disputes over the validity of regulations and the conduct of various kinds of investigations.
Members of 39 Essex appear before the CJEU, domestic tribunals and courts, as well as in arbitration proceedings in a variety of capacities, sometimes as arbitrators. When necessary they engage with the European Commission and other administrations or work in supporting roles for professionals in other jurisdictions.
