Professor Stephen Hawking and Others Granted Judicial Review Costs Capping Order
Professor Stephen Hawking and others have succeeded in securing a costs capping order in their judicial review of government proposals to introduce Accountable Care Organisations in the NHS. Mrs Justice Cheema-Grubb held that the proceedings are public interest proceedings, and it would not be reasonable to expect the claimants individually to bear a high degree financial risk where they are bringing the claim in a representative capacity and have no direct personal interest in the outcome of the case.
Peter Mant appeared for the Claimants. Rose Grogan appeared for NHS England.
