Permission to appeal granted following first DIFC TCD construction trial

Alexander Burrell has successfully obtained permission to appeal before the DIFC Court of Appeal, in the case of Panther Real Estate Development LLC v Modern Executive Systems Contracting LLC TCD 003/2019 26 September 2022. Alexander was instructed on behalf of the defendant in the first instance proceedings, which concerned the first construction trial in the DIFC Court’s TCD, with DIFC governing law. The claimant also obtained permission to appeal on its cross-appeal.  As a result, this appeal will set DIFC law precedent on certain common construction law points, in particular regarding EOT notification conditions precedent.
