Katherine Apps KC and Dan Laking acting for Association of Personal Injury Lawyers legal challenge to fixed costs

On 22 August 2023 the Association of Personal Injury Lawyers issued judicial review proceedings challenging the extension of fixed recoverable costs to clinical negligence claims valued between £25,000-£100,000 and various other aspects of the new CPR rules which will enter into force on 1 October 2023 including those limiting the recoverable costs for addressing vulnerability, inquests and restoration of companies to the Register. The challenge raises grounds based on the common law, public sector equality duty and access to justice principle. The challenge has been brought against the Lord Chancellor.
