Jack Anderson acts in The Hospital Trust v Miss V and Others

Jack Anderson acted for the hospital trust in The Hospital Trust v Miss V and others [2017] EWCOP 20. Miss V was a young woman with learning disabilities who lacked capacity to sexual relations but fell pregnant in circumstances that were not clear. Following a contested hearing, the Court approved the hospital trust's proposal that it was in Miss V's best interests to undergo a trial of non-therapeutic contraceptive treatment in the form of the contraceptive patch as part of her safeguarding plan. This appears to be the first reported case in which the Court has considered the use of contraception in these circumstances and Mr Justice Cobb gave guidance as to the approach that should be taken to best interests decision-making in this context.
