Handed down on 26 March 2024, the Supreme Court considers how the court should assess damages for pain, suffering, and loss of amenity ("PSLA") in the tort of negligence, where PSLA is caused by both a whiplash injury (attracting a tariff award within the scope of the Civil Liability Act 2018), and a non-whiplash injury (which attracts no such tariff).

Dan Laking and Celia Reynolds provided an early exploration of the unanimous judgment of Lord Burrows, which enunciates a step-step approach for assessing such injuries.

They looked at the common law approach to assessment of PSLA, Lord Burrows' approach to the statutory interpretation of the Civil Liability Act 2018, and reflect on what we have learnt from the judgment.
