Grace Cheng speaking at The Law Society’s Dispute Resolution Conference 2023

Dispute Resolution  Conference 2023 - blueGrace Cheng has been invited to speak at The Law Society’s Dispute Resolution Conference on 14 September 2023. Grace will be speaking on the topic of ‘The rise of international courts’ alongside Frank Kroes (partner at Baker & McKenzie Amsterdam N.V.) and Nick Humphrey (partner at Norton White). The session will be moderated by Sir William Blair who was the former Judge in charge of the London Commercial Court, and presently Judge of the Qatar International Court, and an associate member of 3 Verulam Buildings.

Business transactions are now routinely cross-border whereas national courts serve only a single jurisdiction. Cross-border private commercial disputes were routinely resolved via international commercial arbitration but innovation in globalising dispute resolution has given rise to a new kind of court - international commercial courts. These International Commercial Courts have generally been established in financial centres such as Dubai (DIFC), Abu Dhabi (ADGM), Qatar (QICDRC), Singapore (SICC), the Netherlands (NCC) and Kazakhstan (AIFC) under the domestic laws but with procedures to attract litigants to these fora. Are businesses opting to litigate in these new International Commercial Courts and are they a threat to national court litigation?
