Capacity assessment after JB: Challenges and Promises

This webinar, is presented by speakers including Vikram Sachdeva KC, Alex Ruck Keene KC (Hon) and Neil Allen, will take stock of capacity assessment two years since the hearing in A Local Authority v JB [2021] UKSC 52, including consideration of subsequent case-law such North Bristol NHS Trust v R [2023] EWCOP 5, and the delay to the publication of the updated Code of Practice to the Mental Capacity 2005.
It will include such matters as:
- What place diagnosis?
- How far does capacity take into account the interests of others?
- How relevant is relevant information?
- How far does the death of ‘act-specific’ assessments reach?
- How detailed do determinations have to be?
Chaired by Mr. Justice Cobb, the Family Division Liaison Judge for the North-Eastern Circuit for over 6 years. Since October 2021 he has been the Lead Reform Judge, supporting the judiciary through HMCTS’ digitisation programme across all jurisdictions. He has delivered judgments across the spectrum of family law and the Court of Protection, and has sat as an appeal judge both in the High Court and in the Court of Appeal. Before his appointment to the Bench, he was Chair of the Family Law Bar Association (2010-2011), and Head of Chambers at 1 Garden Court (2007-2013).
