Vikram Sachdeva QC and Nicola Kohn win the right to continued ventilation for Tafida Raqeeb

This morning Mr. Justice MacDonald handed down judgment in two claims made in a 5 day hearing in September. In the judicial review claim the judge made a finding that the Trust had unlawfully failed to consider Tafida’s rights to travel abroad for medical treatment under Article 56 of the Treaty on the Functioning of the European Union. His Lordship also accepted their arguments that it was in Tafida’s best interests for ventilation to continue in the Family Division inherent jurisdiction claim.

Alan Bates of Monckton Chambers was also instructed.
