Stephen Tromans QC represented a group of residents in Norton Canes in a successful group action against a secondary aluminium foundry and casting works, Norton Aluminium Limited. In his judgment handed down on 28th September 2012, HHJ McKenna gave judgment for the lead claimants for odour nuisance and awarded damages in accordance with the approach submitted by the claimants. The total of damages for all 132 claimants is likely to be in the order of £1.4 million, probably one of the largest awards in private nuisance. The directors of the company took the view that the effect on the company would be “catastrophic” and the company has now gone into administration.
