This paper considers environmental case law from May 2006 – May 2007.  In particular, it covers a case on contaminated land which could have significant implications for privatised utilities; a couple of cases relevant to environmental consultants including liability and insurance cover; several cases on nuisance and statutory nuisance; the Courts’ first look at carbon trading; a challenge to an SSSI designation which serves as a useful reminder to the limitations of judicial review applications; the legality of public consultations; the extent of environmental cover under public liability insurance; some practicalities to do with environmental protestors; tax treatment of environmental remediation and the latest word on protective costs orders.
