Stephen Tromans QC and James Burton act for the Heath and Hampstead Society in the Society’s challenge to the decision of the City of London to seek planning permission for various works to and in connection with the Ponds on London’s Hampstead Heath. The challenge involves consideration of the interaction between the specific Act of Parliament that protects Hampstead Heath, the Hampstead Heath Act 1871, and the general legislation that applies to reservoirs of a certain type and size, which includes some of the Ponds; the Reservoirs Act 1975. It also requires analysis of the extent to which the Reservoirs Act allows for an approach to safety that takes account of matters such as heritage, the environment and “real world” risk. The claim was heard by Mrs Justice Lang over two days on 13.11.2014 and 14.11.2014. Judgment is awaited.
