Simon Edwards succeeded in a Chancery Division trial where he represented (with Ben Tankel as his junior) solicitors seeking to establish their right to be paid. He saw off a challenge based on alleged breach of the Contracts Made in a Consumer’s Home or Place of Work Regulations 2008. The client’s counterclaim for damages for negligent advice was dismissed. The client was found to be in repudiatory breach of the retainer. The court awarded damages to the solicitors to include loss of success fee.
