This paper was originally presented at a seminar in Chambers in November 2005.

There have been a number of recent changes in the field of sex discrimination, not least as a result of the introduction of the Employment Equality (Sex Discrimination) Regulations 2005 which came into force on 1st October 2005.  The aim of this paper is to review some of those recent developments, with particular emphasis on:

  • the Burden of Proof;
  • the New Definition of Indirect Discrimination;
  • the effect of the complainant’s tolerance of/or participation in discriminatory behaviour.
