This paper was originally presented at the TECBAR Annual Construction Law Seminar in February 2005.

The purpose of this paper is to give an overview of some of the more significant developments in arbitration law over the last 12-18 months. Cases are divided into subject groups as follows:-

  • Section 68 : Challenging the Award – serious irregularity;
  • Sections 43/44: Disclosure, powers of the court exercisable in support of arbitral proceedings;
  • Section 18: failure of appointment procedures;
  • Other decisions of interest.
