This workshop will consider and discuss the impact of recent decisions in resolving professional liability disputes.
Retainers and the duty of care: Emily Formby will consider solicitors’ retainers and the risk of liability despite the absence of a retainer or a fee: Lejonvarn v. Burgess , Cathal Anthony Lyons v. Fox Williams LLP  and Caliendo v. Mishcon de Reya 
Breach of duty: Marion Smith QC will speak about the application and development of the Bolam test and the duty of care in investment advice: O’Hare v Coutts & Co  and Montgomery v Lanarkshire Health Board .
Causation and damages: Adam Robb will cover the principles of damage and how to ensure that the “right” compensation is paid: Wellesley Partners v Withers LLP , Lowick Rose LLP v. Swynson Ltd  and BPE Solicitors v. Hughes Holland 
PI Insurance: Edmund Townsend will consider the implications of AIG v. Woodman  and the meaning of “related matters or transactions”.
