Topics and speakers:

This workshop will consider and discuss the impact of recent decisions in resolving professional liability disputes.

Retainers and the duty of care: Emily Formby will consider solicitors’ retainers and the risk of liability despite the absence of a retainer or a fee: Lejonvarn v. Burgess [2017], Cathal Anthony Lyons v. Fox Williams LLP [2016] and Caliendo v. Mishcon de Reya [2016]

Breach of duty:  Marion Smith QC will speak about the application and development of the Bolam test and the duty of care in investment advice: O’Hare v Coutts & Co [2016] and Montgomery v Lanarkshire Health Board [2015].

Causation and damages:  Adam Robb will cover the principles of damage and how to ensure that the “right” compensation is paid: Wellesley Partners v Withers LLP [2016], Lowick Rose LLP v. Swynson Ltd [2017] and BPE Solicitors v. Hughes Holland [2017]

PI Insurance: Edmund Townsend will consider the implications of AIG v. Woodman [2017] and the meaning of “related matters or transactions”.
