Richard Spearman QC delivered a paper entitled “Privacy and the Internet” on 21 September 2012 at the Middle Temple South African Legal Conference in South Africa.

This paper covered the problems presented by the Internet, including social media, with regard to giving effect to injunctions to restrain misuse of private information.

The paper also suggested possible solutions to these problems, including “reading across” into this area the power to grant injunctions against intermediaries which was the subject of the ground-breaking decisions concerning infringement of copyright of Arnold J in Twentieth Century Fox Film Corpn v British Telecommunications plc [2011] RPC 28 (“20C Fox v BT”) and 20C Fox v BT (No 2) [2011] EWHC 2714 (Ch), in which Richard appeared successfully for the claimant Hollywood film studios.
