Barristers at 39 Essex Chambers are often involved with both statutory challenges and judicial review claims. Acting for developers, local and central government and third parties.

Significant cases:

  • Gatwick Airport,  The claim challenges the CAA’s classification of airspace changes and its interpretation of when its duties arise to carry out the Secretary of State’s Airspace Change Process under the Civil Aviation Authority (Air Navigation) Directions 2001.
  • Royal Society for Protection of Birds v Secretary of State for Communities and Local Government [2014] EWHC 1523 ,challenge to the grant of a runway extension and new terminal building.
  • Hunston Properties Ltd v City and District Council of St Albans 2013] EWCA Civ 1610 one of the leading cases on the approach of the NPPF to housing need.
  • Oxford Aviation Services and Biggin Hill Airport v Secretary of State for Transport, Secretary of State for Defence and Civil Aviation Authority, Judicial Review challenging MOD, Secretary of State for Transport and CAA as to the regulation of civil commercial traffic at military aerodromes in UK.
  • BPAG v Eastleigh Borough Council, judicial review of a planning permission for large-scale residential and associated development.
  • R (Daws Hill Neighbourhood Forum) v Wycombe District Council and Wimpey Taylor [2014] EWCA Civ 228, first, and historically important, judicial review of a decision on “Neighbourhood Planning” under the Localism Act 2011.
  • Luton Borough Council v Central Bedfordshire Council, an important challenge to the duty to co-operate between neighboring authorities.
  • Grafton Group and British Dredging v Secretary of State for Transport, statutory challenge to the decision of the Secretary of State for Transport to confirm the CPO following the Orchard Wharf conjoined CPO/planning public inquiry.
