Recent studies estimate that as many as 1 in 6 children have experienced some form of abuse in their lifetime, whether physical, psychological or sexual.
The issue of abuse has come to prominence in the last few years, highlighted by the Jimmy Savile scandal. The ongoing claims and investigations into local authorities, care homes, healthcare providers, religious, youth, educational, sports, political and other institutions, have been widely publicised. The surge in the number of incidents reported in recent years together with recent decisions of the Supreme Court have opened the door to a raft of claims for damages by those who have been subject to abuse. These claims are factually sensitive and often give rise to complex legal issues including failures to safeguard, consent, limitation, vicarious liability and quantification of loss.
39 Essex Chambers has a dedicated group of barristers who offer specialist knowledge in this evolving area of law. The team has broad experience in abuse and neglect matters ranging from allegations of low level bullying between children, abuse of the vulnerable and elderly, Human Rights Act claims, and complex claims related to the Winterbourne View scandal and public investigations such as The North Wales Child Abuse and Jimmy Savile inquiries. As well as Court proceedings, members have also participated in public inquiries in this area such as Waterhouse Inquiry and are also involved in the ongoing Independent Inquiry into Child Sexual Abuse.
