Peter Village QC has succeeded in overturning a refusal of planning permission by Stratford on Avon District Council for some 85 houses. Permission was refused on the grounds of the alleged safety implications of locating development close to an existing microlight airfield.
The Inspector allowed the appeal finding that the risk to safety was very much lower than the accepted thresholds of tolerability. He made an award of costs in favour of Peter’s client (Persimmon Homes) on this and related issues.
