Permission has been granted to the BMA (and others) to challenge the Government's reduction in the value of the public service pension scheme to doctors

The challenge is being brought to directions intended to address the discriminatory effect of public service pensions, as found in the McCloud judgment.

The grounds of challenge are that the directions issued by the Government regarding the pension cost cap mechanism are contrary to the relevant guidance and policies, that the Government failed to adequately consult on the directions and obtain and take into account relevant information about the directions, and acted in breach of the public sector equality duty.

The case will be heard together with a related claim brought by the Fire Brigades Union.
