Pain, Consciousness and the Law

This seminar will consider how the topics of pain and consciousness are dealt with by the courts, in cases in the Court of Protection, the Family Division, and in the context of personal injury awards.  How do we know if a patient can feel pain? What does it mean to have no conscious experience?  What can medical science tell us, and what can we learn from philosophy in addressing these exceptionally difficult questions?

  • Dr Daniel Lumsden, Consultant in Paediatric Neurology and Complex Motor Disorders at Guys and St Thomas' NHS Foundation Trust
  • Dr Sam Coleman, Reader in Philosophy of Mind and Cognitive Science at the University of Hertfordshire
