Mental Health Act assessments should be in person and not remote

The Divisional Court made clear that assessments by doctors and AMHPs considering whether someone should be detained under the Mental Health Act 1983 should be in person face to face and not remote.

Fenella Morris QC acted for the NHS Trust who brought the issue to the Court in order to clarify the law in the light of uncertain guidance from the Department of Health and Social Care.
