Martin Edwards wins Hedgerow Replacement Notice appeal with costs

Martin Edwards has won an appeal against a Hedgerow Replacement Notice served by Ashford Borough Council under the Hedgerow Regulations. The appeal was determined following a two day inquiry. The inspector agreed with Martin that there had been no breach of the Regulations because the works that had been carried out were for the proper maintenance of the hedgerow and that, on the facts, the hedgerow was not an “important hedgerow” for the purposes of the Regulations because it did not contain the requisite number of woody species and was less than 30 years old. The inspector also agreed with Martin that Ashford Borough Council had acted unreasonably and made a full award of costs in favour of Martin’s clients.
