This paper was originally presented at a seminar in Chambers in April 2008.
This paper addresses those sections of Part 10 of the Local Government and Public Involvement in Health Act 2007 (‘the 2007 Act’) dealing with local assessment of allegations of misconduct. It carries a significant health warning. Whilst the relevant regulations were laid before Parliament on 17.4.08, (‘the local assessment regulations’) the Standards Board will not be publishing the necessary guidance until “early May.” This is hardly satisfactory when the Regulations are to come into force on 8.5.08. The paper will therefore make suggestions, but cannot hope to offer definitive views.
