Kenyan Emergency Group Litigation claims dismissed

On 21 November 2018, Stewart J handed down judgment in Kimathi and others v Foreign and Commonwealth Office in respect of the second of 25 test claims arising  from the alleged actions of the British colonial administration in Kenya during the State of Emergency declared in 1952 to deal with the Mau Mau uprising.  Having heard closing submissions on behalf of the Defendant, Stewart J dismissed the test claim.

Upon that judgment, all other remaining test claims were dismissed.  As such, after 228 days of trial, the Defendant successfully defended the claims.
