Justine Thornton successfully resisted a High Court challenge to quash an EIA screening decision and planning permission for a large vehicle testing and proving ground in Leicestershire. The challenge alleged errors in the screening assessment in relation to noise. Issues in the case included the proper approach to assessing multiple planning applications; assessment of cumulative environmental effects and the correct baseline against which to assess environmental impacts. Justine appeared for the Secretary of State before Mr Justice Supperstone. The Claimant is appealing to the Court of Appeal.
