Justine Thornton appeared for the Secretary of State in a statutory challenge by Westminster Council to the decision of a planning inspector to grant planning permission to Sainsbury’s for a supermarket in central London. The challenge was to the Inspector’s assessment of noise and his approach to a delivery and servicing plan. The Administrative Court dismissed the claim and ordered the Council to pay the Secretary of State’s costs. Saira Kabir Sheikh QC appeared for Westminster Council.
