Justine Thornton successfully defends High Court challenge to Sainsbury

Justine Thornton appeared for the Secretary of State in a statutory challenge by Westminster Council to the decision of a planning inspector to grant planning permission to Sainsbury’s for a supermarket in central London.  The challenge was to the Inspector’s assessment of noise and his approach to a delivery and servicing plan. The Administrative Court dismissed the claim and ordered the Council to pay the Secretary of State’s costs. Saira Kabir Sheikh QC appeared for Westminster Council. Natalie Lieven QC appeared for Sainsbury’s.
