Justine Thornton successfully defended a challenge to government policy on development in the green belt. Justine acted for the Secretary of State for Communities and Local Government in a challenge to a ministerial statement clarifying the Government’s approach to unmet need and development in the Green Belt.
The Claimants sought to argue that the ministerial statement changed government policy and a Planning Inspector had acted unfairly in not giving them an opportunity to comment on the statement at an appeal hearing. Mr Justice Supperstone in the Planning Court found that the ministerial statement simply clarified government policy and accordingly, there was no unfairness in the Inspector’s use of the statement.
