Jeremy Morgan QC succeeds again for the Legal Services Commission

Jeremy Morgan QC succeeded again for the Legal Services Commission in a second judgment on the LSC’s rights to recover payments on account made under the Legal Aid Act 1988 – LSC v Loomba and others [2012] EWHC 29 (QB), Cranston J.  The earlier case was the CA decision of LSC v Henthorn [2011] EWCA Civ 1415.  In both cases he was instructed by CKFT Solicitors, and he led Rachel Sleeman in Loomba and Nicola Rushton in Henthorn.  The results have important implications well beyond their particular facts.  Both were test cases on the LSC’s powers to recoup (Loomba) and on limitation (Henthorn), and a number of other claims have been stayed pending the outcome of these.  For more details see Legal Services Commission v Loomba, Ulasi and Carter and others  and Legal Services Commission v Henthorn.
