Jenni Richards QC successfully defended a decision of the General Medical Council’s Investigation Committee to consider new evidence and further particulars of allegations against a general practitioner arising out of the death of a patient in R (on the application of Joanne Rudling) V General Medical Council (2018) [2018] EWHC 3582 (Admin).

Mrs Justice Farbey dismissed the doctor’s judicial review claim, holding that where a medical practitioner’s fitness to practice was being investigated and the General Medical Council had, as required by the General Medical Council (Fitness to Practise) Rules Order of Council 2004 Sch.1 r.7, notified the practitioner of the allegations and particulars of impairment, it was not obliged to send a fresh r.7 notice if it amended or expanded upon those allegations or particulars.
