Jenni Richards QC and Rose Grogan Granted Permission to Appeal in the case of Mrs M – 24 February 2016

Jenni Richards QC and Rose Grogan have today secured permission to appeal, on behalf of Mr and Mrs M, against a ban on their using their late daughter’s frozen eggs so that she can become pregnant with her own grandchild – something they say was their daughter’s dying wish.

Lord Justice Treacy said in his judgment:

“I have to say that on a reading of the papers I was doubtful whether the appellants would be able to establish a sufficiently strong case so as to enable this matter to go forward. However we have had the benefit of clear and persuasive submissions from Ms Jenni Richards QC which have led me to change my mind and to conclude that there is an arguable case with a real prospect of success.”

A full appeal will now be heard by the Court of Appeal.
