James Potts defends £160m fraud prosecution by Serious Fraud Office

James Potts is acting for one of the defendants in the SFO’s £160m Celtic Energy prosecution relating to transfer of restoration obligations for four South Wales coal mines to BVI companies. Uniquely, the SFO is proceeding by way of an application for a voluntary bill of indictment following dismissal of the charges by a High Court Judge in February (R v Evans [2014] 1 WLR 2817). The case involves complex Insolvency Act, planning and public law issues.

A 9-day hearing starts on 14 October.
