Hefin Rees QC will be speaking on:

  • The case of Harlequin Property, in which he was Counsel for the Claimant in a 7-week TCC trial before Coulson J: ([2016] 3188 EWHC (TCC)).
  • This case was profiled by The Lawyer Magazine as one of the top 20 cases of 2016.
  • Coulson J reached some strident conclusions on the facts of the case, and Hefin will examine what lessons can be learnt for developers involved in international construction projects.

Ben Olbourne will be speaking on:

  • Multi-tiered dispute resolution clauses, a typical but often problematic feature of international construction and project agreements.
  • Issues of applicable law, the construction and effectiveness of such clauses (in particular obligations to participate in ‘friendly’ or ‘ good faith’ discussions), the degree of compliance required with the terms of any binding preconditions to litigation or arbitration, and the consequences of non-compliance with such preconditions.
  • Ben will compare the English law position with that in a number of other, principally SE Asian, jurisdictions.

Melissa Shipley will be speaking on:

  • Notice provisions in international construction contracts.
  • ‘Good’ and ‘bad’ drafting, specifically what is required for notice provisions to be enforced, comparing the approach in different jurisdictions.
  • She will also explore recent cases to consider what arguments have been successfully made to defeat the operation of notice clauses.
