Ready Makers Inc v Christina Macedo Digital Asset Litigation in the Supreme Court of Gibraltar
39 Essex Chambers’ barrister Philippe Kuhn, acting as part of the defence team for Play Network, successfully appeared in the Supreme Court and Court of Appeal of Gibraltar, which both refused to reinstate a worldwide freezing order and trust preservation order on the assets of technology company Ready Gibraltar.
The Court of Appeal upheld a decision to lift injunctions that had previously prevented Ready Makers Gibraltar from using or transferring its shares and digital tokens. The claimants asserted ownership over the assets, which were subject to a worldwide freezing order valued at 542 million $PLAY tokens.
Ready Makers Gibraltar argued that the asset freeze was harming its business. The Court agreed, finding that the restrictions posed a risk of further damage and lacked sufficient legal basis. As a result, the Court concluded that interim restrictions were unnecessary while the dispute continues, allowing the company to resume normal operations.
