39 Essex Chambers welcomes new tenants: Kerry Bretherton KC and Rebecca Cattermole
39 Essex Chambers is delighted to announce that Kerry Bretherton KC and Rebecca Cattermole have joined its membership, with immediate effect.
Kerry and Rebecca join the Planning, Environment and Property Team. 39 Essex Chambers has expanded our established property team in response to increased demand and to enable us to meet the needs of our clients, including solicitors, developers, local and central government and others, through the breadth of our expertise. Kerry and Rebecca are happy to assist with informal direct phone or email queries and work in a collaborative manner to ensure that they can provide a swift response. Kerry Bretherton KC is an outstanding silk who was nominated for property litigation silk of the year by Legal 500 in 2022, Kerry has been described as “excellent on her feet” and “fantastic to work with…her response times are amazing”. She has acted in the Supreme Court and Court of Appeal in a number of the leading property cases. Kerry litigates and advises in all aspects of property, and property development and commercial disputes often arising out of development or property transactions as well as associated professional negligence. Typically, her work involves high value and complex disputes. Kerry frequently undertakes work in the following areas: options and overage, restrictive covenants, freehold covenants, easements, agricultural, conveyancing disputes, construction and building safety, conveyancing disputes and L&T. Kerry is co-author of “The Electronic Communications Code: A Practical Guide” the 2nd edition is due for publication in May 2023. She is also a contributor to “Service Charges and Management 5th Edition”.

Rebecca Cattermole is an established and well-known junior in property and agricultural work, she has been described by Chambers UK 2023 as “exceptionally intelligent...”. Rebecca has also appeared in Legal 500 2023 Agriculture (Tier 1) for a number of years, more recently said to be “.. an exceptional team player [who] is able to distil an enormous amount of detail into straightforward submissions. She is a natural strategist and her knowledge in this area of law is second to none.”. As well as the full range of landlord and tenant matters, Rebecca’s practice covers restrictive and freehold covenants, easements, nuisance, and complex issues surrounding the recovery and development of land. Rebecca has appeared in the Supreme Court, Court of Appeal and High Court in a number of important cases including the first appellate case in England and Wales on the availability of equitable set-off to defeat a notice to quit under the Agricultural Holdings Act 1986. Rebecca is a contributor to three editions of Service Charge and Management: Law & Practice, Halsbury’s Laws and Jowitt’s Dictionary of English Law (Landlord and Tenant) and has written other legal textbooks since she was 3 years’ call. Rebecca is a fellow of the Agricultural Law Association and a member of the Property Bar Association and Ecclesiastical Law Association.
