High Court Rejects Challenge to Waste Site in Essex

The High Court has dismissed a challenge brought against planning permission issued by the Defendant, Castlepoint Borough Council, granted for development at a waste site in Benfleet, Essex. The Challenge was brought on three grounds, that the site was contaminated and should have been subject to proper assessment in accordance with local and national guidance, that the potential for intensification had not been properly considered, and that the Green Belt harm had been inadequately addressed. Mr C. M. G. Ockleton, sitting as a Deputy Judge of the High Court, dismissed the challenge on all three grounds.
