Gordon Nardell QC was a member of a panel of expert speakers invited by newly-merged international law firm Squire Patton Boggs to address their Environment Group’s annual client conference in June. Gordon gave a paper on the way recent decisions of the Court of Justice of the European Union have balanced the proportionality principle with a precautionary approach to environmental protection. The judgments discussed included Shell Nederland and Belgian Shell (12 December 2013, Cases C-241/12 and 242/12) on whether debunkered off-spec fuel was “waste”, and Sweetman v. An Bord Pleanála (11 April 2013, Case C-258/11) on the legality of an infrastructure project involving partial loss of a priority habitat type. A copy of Gordon’s presentation can be found here.
